Consequence:
IF THE BOLTS DO NOT HAVE THE PROPER TORQUE APPLIED, THEY COULD COME OFF THE VEHICLE WHILE DRIVING CAUSING POOR VEHICLE HANDLING INCREASING THE RISK OF A CRASH.
Remedy:
DEALERS WILL VERIFY THE SHACKLE BOLTS HAVE THE CORRECT TORQUE AND RE-TIGHTEN IF NECESSARY. ALL VEHICLES ARE STILL AT DEALERS. NO TRAILERS HAVE BEEN SOLD TO CUSTOMERS.

A JUDGE RULES IN FAVOR OF THE CONSUMER IN AN RV LEMON LAW CASE

A Pittsylvania County couple won a significant victory for consumers under the state's lemon law. In the past, judges found the law didn't apply to recreational vehicles. But it does now.
Henry and Suzanne Reynolds work and play hard. Travel is their reward. They bought a brand new RV, and they paid $211,000 for it. They purchased it two years ago, but they only used the Mandalay Motor Coach for 17 days. It's been in the shop the rest of that time.
The RV has so many problems, the Reynolds' lost count of them. But the couple wasn't too concerned. After all, Four Winds International's promotional literature says it's covered by "bumper to bumper" warranty.
If this had been a conventional car or truck, there would be no question: the state lemon law would require the company to give the couple a new RV, or give them their money back. But Four Winds relied on case law that held RV's are not really "motor vehicles."
While Judge Jackson Kiser declared Virginia's lemon law "perfectly ambiguous," he decided a motor home does fit the definition of "passenger car." The judge ruled that it was the intent of the General Assembly to alleviate the hardship on consumers caused by the purchase of defective motor vehicles. Most important, Judge Kiser ruled an RV is a motor vehicle.
While that's a major victory for the consumer, the Reynolds are a long way from getting their money back, or a new RV. Their complaint is set for trial in federal court next month.
Meanwhile, they're stuck making a monthly payment of $1,400.

Consequence:

Recognizing that RV owners value prompt availability of needed parts, Damon Motor Coach has developed two new “quick ship” parts programs – Trip Saver and Rapid Response Parts.
Damon said the goal of its Trip Saver program is to get retail customers back on the road as quickly as possible. Specifically, the program commits Damon to ship via overnight delivery services any qualifying part within 24 business hours of receiving the order. Qualifying parts include those items most frequently needed by motorhome owners and a list is available from Damon.
The Rapid Response program provides a commitment by the company to ship select parts to dealers within 24 hours. Qualifying parts in the Rapid Response program are also defined as those items most frequently needed for vehicle service work.
Janae Kurtz, vice president of parts and service for the Elkhart, Ind.-based builder, said the new programs demonstrate the company’s commitment to customer service.
“We realize that prompt delivery of needed parts speaks volumes about the service culture of a company,” said Kurtz. “This kind of responsiveness is especially critical to RV owners who may be traveling and in dire need of a part to continue their journey.”

National RV Holdings Inc. is taking steps with the Securities and Exchange Commission (SEC) to deregister its common stock.
The Perris, Calif.-based company, parent to motorhome builder National RV Inc., filed a form with the SEC that will “suspend its obligation to file reports.”
National RV Holdings said it is eligible because the company has fewer than 300 holders of record of its common stock. The company's obligation to file reports will terminate in 90 days, unless the SEC denies the filing, and it anticipates that deregistration of its common stock will become effective around Feb. 6, 2008.
"After assessing the advantages and disadvantages of remaining a registered company, our board of directors unanimously concluded that it is in the best interests of the company and its stockholders to deregister its shares,” said CEO Dave Humphreys. “The substantial out-of-pocket cost, as well as the significant demands on management's time and focus, necessary to comply with SEC reporting, including the additional costs that would be required in order to comply with Section 404 of the Sarbanes-Oxley Act, outweigh the benefits the company receives from maintaining its registered status.
“We believe that deregistering will allow us to reduce current expenses, avoid substantial future costs and free our management team to focus more of its time and resources on operating the company."
